Privacy Notice

How LOAM (Fernway Group Ltd.) collects, uses, and protects personal data — both for merchants on the platform and for end customers of stores hosted on LOAM.

Draft notice. This document is an interim version while LOAM's legal counsel finalises the platform's policy stack. It is offered in good faith; for the avoidance of doubt, the binding version will be re-published with a clear effective date once review is complete.

Who we are

LOAM is operated by Fernway Group Ltd., the data controller for merchant account data (registration, billing, support). For end customers of stores hosted on LOAM, each merchant is the controller of their own customer data; LOAM acts as processor.

What we collect (merchants)

When you create a LOAM account we collect your name, business email, store details, and — where applicable — KYC information required by our payments partner. We process this to provide the platform, support your account, and meet legal obligations.

What we process on your behalf (end customers)

For end customers of your store, we process the data necessary to fulfil orders (name, address, contact information) and to run the storefront experience (browsing history, cart state, conversations with Kiln). This data lives in your tenant's isolated database and is not shared across merchants.

Lawful bases

Performance of contract (running the platform and your store), legitimate interests (security, fraud prevention, product improvement), and consent where required (analytics, marketing email opt-ins).

Sub-processors

We use Stripe (payments), our hosting provider, Anthropic / model providers (AI features), and a small set of operational tooling vendors. A current list is available on request.

International transfers

Where data is transferred outside the UK or EEA, we rely on Standard Contractual Clauses or equivalent safeguards. Specific destinations and safeguards are documented in our DPA.

Your rights

Access, rectification, erasure, restriction, objection, portability — exercise any of these by emailing privacy@loam.st. We will respond within statutory timeframes and identify any limitations that apply.

Retention

Account data is retained while you have an active account and for a defined period afterwards for legal and operational reasons. End-customer data retention is governed by each merchant's own policy as set in their store settings.
