1. The platform
LOAM is an AI-native commerce platform operated by Fernway Group Ltd. ("LOAM", "we", "us"). By creating an account or using the platform, you ("you", "the merchant") agree to these terms.
2. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction) and able to enter into a binding contract. You must provide accurate registration information.
3. Your store, your data
Content, products, customer data, and brand assets on your store remain yours. LOAM stores them in a database isolated from other merchants and offers a full export at any time.
Stripe Connect accounts created during onboarding are issued in your legal name; LOAM does not hold or move your funds.
4. AI-generated content
Brand identity, product copy, storefront pages, and the customer agent ("Kiln") are generated using AI models on your behalf. You own the outputs and are responsible for the content you publish — including any edits and any third-party rights it may engage.
5. Fees
LOAM is free to use during beta. Stripe's standard processing fees apply because Stripe processes your payments. We will notify you in advance of any paid plan launching, and beta merchants will receive grandfathered pricing where applicable.
6. Acceptable use
You may not use LOAM to sell prohibited goods, engage in fraud, impersonate others, or violate applicable law. We reserve the right to suspend stores in clear violation, with notice except where notice would frustrate enforcement.
7. Termination
You may close your account at any time. Your data will be made available for export for at least 30 days after closure; after that we may delete it. We may terminate the agreement on reasonable notice or immediately for material breach.
8. Liability
To the extent permitted by law, LOAM is not liable for indirect or consequential losses. Total liability under these terms is capped at the greater of (a) fees paid to LOAM in the prior 12 months or (b) £100.
9. Governing law
These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales unless another forum is required by mandatory consumer protection law.
